论夫妻对子女婚内抚养费的承担——《民法典》第一千零五十八条的理解与适用

On the Spousal Responsibility for Maintenance Fees:Understanding and Application of Article 1058 of the Civil Code

鉴于我国婚内抚养费制度缺乏系统的规定,各地法院对于相关问题的认识不一、实务中缺乏统一的裁判标准,“同案不同判”的现象时有发生。允许直接抚养子女的父母一方提出婚内抚养费主张,并引入《民法典》第一千零五十八条作为其请求权基础,兼具必要性和可行性。通过适用该条款能够达到统一司法实践、正确区分相关概念、合理分配双方举证责任、统一婚内抚养费时间区间等效果。

In view of the lack of systematic provisions in the maintenance payment within marriage,judges around the country have different perceptions of the relevant issues.And the lack of uniform standards for adjudication in practice gives rise to the occurrence of“different sentences for similar cases”from time to time.It is not only necessary but also feasible to allow the parent who raises the child alone to claim the maintenance in proceedings and to apply article 1058 of the Civil Code of the People’s Republic of China as support for the claim.The application of this provision can achieve the effect of harmonizing judicial practice,correctly distinguishing relevant concepts,reasonably allocating the burden of proof between the two parties,and standardizing the time span of maintenance payments.
