近年来,区块链技术在电子档案保管中的适用日益增多。从适用可能性来看,区块链的特性与电子档案保管的要求存在内在契合,现有法律规定为区块链技术在电子档案保管中的适用奠定了基础,且各地区块链存档的实践为区块链技术在电子档案保管中的适用提供了经验基础。但区块链在电子档案保管实践中的适用仍存在问题,既包括区块链技术层面的问题,也包括规则缺乏和衔接不畅等问题。从完善路径来看,电子档案保管者应当基于电子档案的特性对其进行分类管理;立法层面应当明确界定区块链各方主体的权责;国家层面应当制定区块链联盟的标准以进一步促进数据流通等。

In recent years,the application of blockchain technology in electronic records management has been increasing.In terms of applicability,the characteristics of blockchain are inherently compatible with the requirements of electronic records management.Existing legal provisions have laid the foundation for the application of blockchain technology in electronic records management,and practical applications of blockchain storage in various regions provide an experiential basis for its use.However,there are still problems with the application of blockchain in electronic records management practices,including technical issues as well as lack of rules and poor coordination.In terms of improving this situation,electronic record keepers should classify and manage records based on their characteristics.At the legislative level,the rights and responsibilities of all parties involved in blockchain should be clearly defined.At the national level,standards for blockchain alliances should be developed to further promote data circulation.
