清远基层自治规约制定中的问题及其对策探讨

法治社会的建设是全方位、多维度的,其不仅要求党和政府依法治理社会,还要求社会依法自治,充分发挥全体人民的主体作用。依法自治中的“法”实际上包含“硬法”和“软法”。软法作为一种协商和契约,是调节人民内部矛盾的良好手段,尤其在基层社会自治领域发挥巨大作用。村规民约(居民公约)作为自治规约的主要样态,其制定相当于法治过程中的“立法”环节,起着根源性和方向性的作用。因此,为了提高清远基层自治的法治化水平,有必要研究分析清远市村规民约(居民公约)在制定过程中存在的问题并提出相应的优化对策。

The construction of a society under the rule of law is all-dimensional and multi-dimensional.It not only requires the Communist Party of China and the government to govern the society according to the law,but also requires the society to govern itself according to the law and give full play to the principal role of all the people.“Law”in autonomy by law actually includes“hard law”and“soft law”.As a kind of negotiation and contract,soft law is a good means to adjust the contradictions among the people,especially in the field of social autonomy at the grassroots level.As the main form of the autonomy statute,the village rules and residents'convention is equivalent to the“legislation”in the process of the rule of law,which plays a root and directional role.Therefore,in order to improve the level of law-based self-governance in Qingyuan,it is necessary to study and analyze the problems existing in the process of formulating village rules and residents'covenant and put forward the corresponding optimization countermeasures.
