智慧侦查视域下公民隐私权的保障

面对复杂多变的犯罪形势,传统侦查模式显得力不从心,智慧侦查模式能够优化侦查方法以节约侦查资源,快速锁定侦查目标以提高侦查效率,是打击犯罪之利器。但是,智慧侦查模式的运用加剧了“打击犯罪”与“保障人权”二者之间的冲突。要有效解决这一冲突,必须多措并举,如采取明确规制智慧侦查适用的法律规范、优化智慧侦查监督机制、完善对违法侦查行为的惩戒机制、健全隐私权保护救济机制等措施。

Faced with complex and ever-changing criminal situations,traditional investigation models seem to be inadequate.The intelligent investigation model can optimize investigation methods to save investigation resources,quickly target investigation targets to improve investigation efficiency,and is a powerful tool in combating crime.However,the application of the intelligent investigation model has exacerbated the conflict between"cracking down on crime"and"safeguarding human rights".To effectively resolve this conflict,multiple measures must be taken simultaneously,such as adopting clear legal norms for regulating the application of intelligent investigation,optimizing the supervision mechanism of intelligent investigation,improving the punishment mechanism for illegal investigation behavior,and improving the privacy protection and relief mechanism.
