非制式枪支案件入罪与出罪的思考

自公安部对枪支认定的枪口比动能标准进行更改后,认定标准从16 J/cm^(2)到1.8 J/cm^(2),一个数值的改变对整个社会的影响是让所有人都始料未及的,部分玩具枪、仿真枪持有者因此成为非法持有枪支罪、非法买卖武器罪的刑事犯。虽然仅是个案,但其造成的影响不论是对涉案人员的家庭生活还是对整个社会主义法治建设都是巨大且不可逆的。因此在面对非制式枪支案件时,应该依靠法官的司法良知,考虑到修复式鉴定不能直接作为定罪依据,有效区分刑罚和行政处罚,避免“玩具枪入刑”的现象再次发生,以维护司法之体面、法律之尊严。
