论新《职业教育法》中现代职业教育体系建构

On the Construction of Modern Vocational Education System in the New Vocational Education Law

现代职业教育体系是职业教育的关键要素,2022年新修订的《职业教育法》对其做出了回应。党主张的部署落实、实践经验的总结和提供体系化方法的发展需求以及现代职业教育体系的建构不足使得新《职教法》建构现代职教体系具备正当性。新《职教法》以《宪法》价值、职业教育价值和职普融通、内部贯通的原则作为内部体系要素,有着评价性、经验性和开放性三个特征,以规则融贯的体系,对关键原则的落实以及与其他教育法律的衔接作为外部体系的要素。实践中,通过制度和内容两个方面实现职普融通,通过高层次职教的拓展以及不同层次、类型职业教育的贯通实现内部贯通是新《职教法》建构现代职教体系的具体路径。

The modern vocational education system is the key element of vocational education,which is responded to by the newly revised Vocational Education Law in 2022.The deployment and implementation of the Party's proposal,the summary of practical experience and the development needs of providing systematic methods,as well as the lack of construction of modern vocational education system,make the construction of modern vocational education system in the new"Vocational Education Law"legitimate.The new"Vocational Education Law"takes the value of the Constitution,the value of vocational education and the principles of integration of vocational and general education and internal connection as the elements of the internal system,and has three characteristics of evaluation,experience and openness.The implementation of key principles and the connection with other educational laws are the elements of the external system.In practice,realizing the integration of vocational education and general vocational education through the two aspects of system and content,and realizing internal connection through the expansion of highlevel vocational education and the penetration of different levels and types of vocational education is the specific way for the new"Vocational Education Law"to construct the modern vocational education system.
