旅游统计算法的法律规制研究

Study on the Legal Regulation of Tourism Statistics Algorithm

算法技术是推动旅游统计工作高效化和科技化发展的重要工具。文章从法律视角审视旅游统计算法引发的社会问题。首先,基于旅游统计算法的工作原理,总结出算法嵌入旅游统计工作中可能造成个人信息泄露、算法黑箱难规制、决策偏差的“三元问题”。其次,遵循“规制目标→规制理念→规制路径”的逻辑进路,认为要想实现“算法治理与数据保护”和“统计高效与决策精准”的平衡,应采取内部规制路径,将旅游统计算法监管职责归于文化和旅游部门。最后,从旅游统计数据的采集和清洗、算法的设计和处理、决策的输出和应用三个阶段,分别构建旅游统计算法应用的具体规范,以实现负责任和可追责的旅游统计工作算法化。

Algorithm technology is an important tool to promote the efficient and technological development of tourism statis-tics.This paper examines the social problems caused by tourism statistics algorithms from a legal perspective.Firstly,based on the working principle of tourism statistics algorithm,the paper summarizes the“ternary problems”that may cause personal informa-tion leakage,difficult regulation of algorithm black box and decision-making bias when the algorithm is embedded in tourism sta-tistics.Secondly,following the logical approach of“regulatory objectives→regulatory concepts→regulatory paths”,the paper holds that in order to achieve the balance between“algorithm governance and data protection”and“statistical efficiency and ac-curate decision-making”,internal regulation should be adopted,and the supervision responsibility of tourism statistics algorithm should be concentrated in the culture and tourism sector.Finally,from the three stages of collection and cleaning of tourism statis-tics data,algorithm design and processing,and output and application of decision-making,the specific norms of tourism statistics algorithm application are constructed respectively,so as to realize the responsible and accountable algorithmization of tourism sta-tistics.
