环境污染第三方治理与排污权交易制度作为现代环境治理体系的典型代表,皆以引入市场因素、推动公私协作、优化资源配置为精神内核。第三方治理企业参与排污权交易能够实现环境污染第三方治理与排污权交易制度的联结,以机制间的协调融通促进彼此的进一步发展,然而在现有制度框架内,第三方企业尚未有参与排污权交易的合理路径。明确第三方企业在排污权交易中的角色与功能,探索第三方治理中排污权准共有法律关系的创新形式,是实现第三方企业参与排污权交易的有效路径。以第三方企业参与排污权交易为桥梁,实现环境污染第三方治理与排污权交易的规范更新与制度协同,有助于实现两种机制的共促共赢。

As the typical representative of modern environmental governance system,the third-party environmental pollution control and emission trading system both take introducing market factors,promoting public-private cooperation and optimizing resource allocation as their spiritual core.The participation of third-party governance enterprises in emission trading can realize the connection between the third-party governance of environmental pollution and the emission trading system,and promote the further development of each other through the coordination between mechanisms.However,in the existing institutional framework,the third party governance enterprises have not yet had a reasonable path to participate in emission trading.Clarifying the role and function of third-party governance enterprises in emissions trading,and exploring innovative forms of quasi-common legal relationship of emissions rights in third-party governance are effective ways to realize third-party governance enterprises'participation in emissions trading.Taking the participation of third-party governance enterprises in emissions trading as a bridge to realize the normative updating and institutional coordination of the third-party governance of environmental pollution and emissions trading will help to achieve the win-win results of the two mechanisms under the new environmental pollution governance model.
