摘要
佩雷尔曼的合理化理论是新修辞学理论的哲学基础,也是法律修辞学的逻辑起点。合理化理论主要包括三项内容:其一,合理化理论认为共识是说服和论证的起点,并且合理化的行为不得违背常识。其二,合理化理论认为在没有本质区别的情况下,应当对类似情况予以类似性的处理。在价值判断领域,应当依靠论证技巧,合理决策与行为。其三,合理化理论认为应当妥善处理语言的本质特性,充分发挥语言在说服中的重要价值。
Perelman’s reasonable theory is the philosophical basis of the new rhetoric theory and the logical starting point of the legal rhetoric.The reasonable theory mainly includes three contents:First,the reasonable theory holds that agreement is the starting point of persuasion and argumentation,and the reasonable behavior should not violate common sense.Second,the reasonable theory holds that similar cases should be treated similarly when there are no essential differences.In the field of value judgment,we should rely on argumentation techniques to make reasonable decisions.Thirdly,the reasonable theory holds that we should properly deal with the essential characteristics of language and give full play to the important value of language in persuasion.
