生态环境损害赔偿制度的视检与完善——基于陕西省实施分析

Inspection and improvement of ecological environment damage compensation system——Implementation analysis based on Shaanxi Province

生态环境损害赔偿制度是我国生态文明体制体系建设的重要组成部分。目前在完善生态环境损害赔偿制度的过程中,仍存在磋商规定的不统一性、赔偿资金的使用与管理的不透明性等诸多问题。本文在深入解读陕西省各市已经实施的改革方案及磋商、生态损害赔偿金的使用规定等配套策略的基础上,对当前我国生态环境损害赔偿制度面临的制度性难题进行系统分析,以期促进生态环境损害赔偿制度的立法进程,从而对我国生态文明体系的进一步完善提供有力支撑。

Establishing the system of environmental damage compensation is an essential component of China's ecological civilization system reform.There are currently issues such as inconsistent consultation regulations and unclear management of compensation funds.This article elaborates on the reform implementation plans and supplementary measures,such as consultation methods and the use of environmental damage compensation funds,that have already been introduced in various cities of Shaanxi Province.It also analyzes the urgent problems that need to be addressed in the current system in our country,aiming to promote the legislative process of the ecological and environmental damage compensation system and further perfect China's ecological civilization framework.
