“河长+检察长”制在河道治理中的实践及其完善

河道治理是流域防洪工作和生态环境保护的重要环节。“河长+检察长”制是在河长制的基础上衍生出的一种新的部门协作机制,能够为河道治理提供制度保障。“河长+检察长”制通过吸纳检察机关的法律监督功能,实现行政执法与公益检察的深度合作,形成河流管理与保护的强大合力。但是,该机制在实践中存在跨区域协作机制缺失、多部门联动不足,河道管理部门之间职责划分不清晰,公众参与程度较低等问题。为进一步发挥“河长+检察长”制在河道治理中的效能,需要完善相关法律制度,保障检察机关充分履职,构建一体化执行体系,创新跨区域联动协作机制,积极搭建公众参与平台。

River management is an important part of flood control and ecological environment protection.The“River Chief+Chief Prosecutor”system is a new departmental coordination mechanism derived from the River Chief system,which can provide institutional guarantee for river management.By absorbing the legal supervision role of the procuratorate,the“River Chief+Chief Prosecutor”system realizes in-depth cooperation between administrative law enforcement and public interest prosecution,and forms a powerful joint force for river management and protection.However,the application of this mechanism in the practice of river management has problems such as lack of cross-regional coordination mechanism,insufficient linkage of multiple departments,unclear division of responsibilities among river management departments,and low degree of public participation.In order to further the effectiveness of the“River Chief+Chief Prosecutor”system in river management,it is necessary to improve the relevant legal system,ensure the procuratorial organs fully performtheir duties,build an integrated execution system,innovate cross-regional linkage and cooperation mechanisms,and actively build public participation platform.
