教育法法典化的价值目标

摘要 教育之目的在于立德树人,受教育权的保障和实现是教育事业的核心与重点,教育法法典化是时代之需。以人作为出发点,为教育法典的编纂提供了一个由内生到外化的思维模式。教育法法典化应当重视当前国家与社会之间的发展关系,确立以人为主体的价值目标和基本原则。我国应当以统一的教育法精神外化为教育法典的调整范围,以保障受教育权为核心,以“权利-义务”为范式,结合国情与社会需求,编纂具有系统性、全面性和可操作性的教育法典。同时保证实体与程序并重和相互联动,实现实质正义与形式正义的有机统一。 The purpose of education is to cultivate virtue and talent with the realization of the right to education as the core requirement that calls for the codification of education law of the times.The codification of education law takes humans as the starting point to provide a thinking mode from endogenous generation to external expression for the compilation of educational code.This research argued that the codification requires the coordinative relationship between the state and the public to classify the basic people-centered value orientation and principle for compiling a systematic,comprehensive and concise education code in accordance with national conditions and social demands that aims to protect the public right to receive education as the core in the paradigm of right and obligation.Meanwhile,it emphasized that entities and procedures are interacted on equal basis to realize the linkage of substantive justice and formal justice as an organic unity.
