受贿行贿并重视域下对行贿罪若干疑难问题之探析

Exploration of Certain Difficult Issues Concerning the Crime of Active Bribery under the Emphasis on both Active and Passive Bribes

通过对行贿罪谋取不正当利益、违法所得追缴和特殊从宽处罚条款的相关法律和司法解释的规定进行梳理,分析上述三个问题在司法实务中存在的主要争议,并提出将“行贿受贿并重惩处”的刑事理念贯彻到司法实践当中的观点,探讨如何准确理解谋取不正当利益的内涵、解决违法所得的追缴以及特殊从宽处罚条款的合理适用,以实现行贿与受贿并重处罚之目的。

This article organizes the legal provisions and judicial interpretations relating to the solicitation of improper benefits in bribery,the recovery of illegal gains,and the special provisions for leniency.It analyzes the main controversies in these three issues as they arise in judicial practice and proposes a viewpoint on how to carry through the criminal concept of“equally punishing both active bribery and passive bribery”into judicial practice.The article explores how to accurately understand the essence of soliciting improper benefits,resolve the recovery of illegal gains,and reasonably apply special leniency provisions,all to achieve the goal of equally punishing both active and passive bribes.
