摘要
近年来,越来越多的博物馆试图通过知识产权授权的方式推进文化创意产业的发展、扩大优秀文化的传播范围、延伸公共文化服务的边界。作为博物馆中占比巨大的国有博物馆,在法律主体身份、管理体制等方面具有一定的特殊性。本文通过梳理博物馆IP授权的范围及法律关系,结合现阶段各项法律法规、政策文件等,发现国有博物馆在IP授权中存在主体资格瑕疵、法律适用缺失等法律困境,只有完善国有博物馆IP授权的法律规则才能在一定程度上解决国有博物馆面临的问题,并助力国有博物馆发挥资源优势,提高社会文化服务水平。
In recent years,more and more museums have tried to promote the cultural and creative industries,expand the spreading of excellent culture,and extend the boundaries of public cultural services through intellectual property(IP)authorization.As a large proportion of museums,state-owned museums are special in the aspects of legal subject identity and management system.Through analyzing the scope and legal nexus of museum IP authorization,it’s found that there are many problems on the IP authorization in state-owned museums in the background of existing laws and policies,such as the subject qualification and lack of legal application.Only by improving the legal rules of IP authorization,can the problems faced by state-owned museums be solved to a certain extent.And then the state-owned museums could give play to the resource advantages and improve the public cultural services.
