Taming Algorithm Leviathan:Systematic Governance Mechanism of Algorithmic Risks in Financial Technology Platforms

算法技术促进了金融科技平台的创新发展,但也带来了利维坦式的算法风险。通过案例研究发现,金融科技平台算法风险主要包括算法权力、黑箱与歧视风险,对其实施系统治理的逻辑机理是法律规范亟待完善的内在要求、金融算法风险防范的客观要求、消费者权益尤其是数据权益的保护要求。系统治理的核心要素在于算法的协同性、透明性与可问责性。通过采用比较研究方法,借鉴欧美金融科技平台算法风险的系统治理经验,结合本土化发展情况,我国可以从系统治理原则与路径层面构建系统治理机制,驯服金融科技平台算法风险。

Algorithm technology has promoted the innovative development of financial technology platforms,but it also brings Leviathan style algorithm risks.Through the case study,this paper finds that the algorithmic risks of Fintech platforms mainly include algorithmic power,black box and discrimination risks.The logical mechanism for implementing systematic governance is the internal requirement for urgent improvement of legal norms,the objective requirement for preventing financial algorithmic risks,and the protection requirement for consumer rights,especially data rights.The core elements of system governance lie in the synergy,transparency,and accountability of algorithms.By adopting comparative research methods,drawing on the system governance experience of algorithmic risks on financial technology platforms in Europe and America,and combining with the development of localization,China can construct a system governance mechanism from the level of system governance principles and paths to tame algorithmic risks on financial technology platforms.
