公正:极端事件司法裁判之困境--以米尼奈特号“人吃人”事件为例

公正在不同的场合下有不同的含义。当一个法官要裁判是否让某种行为承担责任的时候,公正就是让应负责任的承担责任,让不应当承担责任的不受惩罚,并无其他附加意义。但是对不寻常的极端案件,在已经设定的公正内涵中,想要完全没有争议的裁判这些极端案例,确并无可能。

Justice means different things in different situations.When a judge decides whether an act should be held re-sponsible,justice means that the responsible should be held accountable,and that those who should not be held responsible should not be punished,and there is no additional meaning.But for unusual extreme events,it is not possible to adjudicate these extreme cases completely without controversy within the meaning of justice.
