新业态工时基准制度的完善研究

摘要 新业态工时基准制度的完善,可以为从业者提供合理的工作生活保障,彰显社会主义制度的优越性。新业态用工模式突破了传统工时制度的治理逻辑,现行工时制度的适用困境主要为以下三点:性质不明的在线时间和混乱的报酬机制使从业者工作时长及收入不尽合理,滞后且粗陋的特殊工时制度无法覆盖新业态工时模式的需要,尚未完善的原则性规定无益于平台企业与新业态从业者在工时约定方面的恣意。在我国劳动法由传统“二分法”逐渐向“三分法”转型的背景下,有必要突破传统劳动法治理体系,发挥算法的优势作用,完善特殊工时制度,构建任务计量型劳动基准,加强对工时条款方面的限制,以实现保障从业者基本权益和满足弹性化用工需求的统一。 The improvement of the working hour benchmark system for New Business Form can provide workers with reasonable working and living guarantees and demonstrate the superiority of the socialist system.The working hour model of the New Business Form breaks through the governance logic of the traditional working hour system.The current system’s application dilemma is mainly reflected in the following three points:unclear online time and the chaotic compensation mechanism make the working hours and income of New Business Practitioners unreasonable;the special working hour system cannot cover the needs of the working hour model of the New Business Form,and the incomplete principled regulations are not conducive to the arbitrary agreement of working hours between platform companies and New Business Practitioners.Under the gradual transformation of Chinese Labor Law from the traditional“dichotomy”to the“trichotomy”,it is necessary to break through the traditional Labor Law governance system,improve the special working hours system,give full play to the advantages of algorithms,build a task-based labor benchmark,and strengthen the restrictions on agreed working hours,so as to achieve the unity of guaranteeing basic labor rights and meeting flexible employment needs.
