新时代城市管理综合执法问题及法律规制探究

Research on Comprehensive Law Enforcement and Legal Regulation of Urban Management in the New Era

近年来我国在立法层面不断提高对城市管理综合执法的重视度,着力于构建现代化生态文明城市。在我国高速城镇化进程中,作为由相对集中行政处罚权发展而来的城市管理综合执法制度随着城市化不断发展和完善,立法和政策也不断为城市管理综合执法提供愈来愈细化的支持,使其逐渐成长为城市管理领域的跨部门综合执法,并最终演变为与相对集中行政处罚权并不相同的概念。从城市管理综合执法的理论基础和概念阐释入手对我国当前的城市管理综合执法现状进行了条分缕析,指出其存在的诸如立法体系不健全、执法机制不成熟、配套机制不完善等困境,并对其背后的法律层面的原因进行深入探讨后,认为应当从健全立法,有效保证执法依据;规范执法,落实法律保障人权;完善配套措施,形成执法长效机制等方面入手加以解决,从而使其步入良性循环的发展之路,加快推进市域社会治理现代化,提高我国的市域社会治理能力。

In recent years,China has continuously increased its emphasis on the comprehensive law enforcement of urban management at the legislative level,with a view to constructing modern cities of ecological civilization.Against the background of speedy urbanization in China,the comprehensive law enforcement system for urban management developed from relatively centralized administrative penalty power continues to develop and improve with urbanization.Meanwhile,legislation and policy initiatives are also providing increasingly detailed support for the comprehensive law enforcement of urban management,causing it to mature into a cross-departmental comprehensive law enforcement entity,and ultimately evolve into a concept different from relatively centralized administrative penalty power.Starting from the theoretical basis and conceptual interpretation of comprehensive law enforcement of urban management,this paper analyzes the current situation of comprehensive law enforcement of urban management in China while identifying the existing difficulties that hinders its development,such as imperfect legislation system,immature law enforcement mechanism and imperfect supporting mechanism.After an in-depth investigation into the legal reasons behind these difficulties,it is believed that efforts must be made to promote sound legislation that will effectively strengthen the legal grounds for law enforcement,standardize law enforcement that will protect human rights in accordance with the law,optimize supporting measures that will help form a long-term mechanism for law enforcement,et cetera.All these will conduce to forming a virtuous cycle of development,accelerating the modernization of urban social governance,and improving China’s urban social governance capacity.
