法治督察工作机制是法治中国建设中的一项特色性制度安排。法治督察工作机制的生成遵循着“厉行法治”与“自我革命”的历史逻辑,蕴含着公共管理学中的“委托-代理”理论的理论逻辑,贯彻着习近平法治思想中“法治中国建设方法论”的实践逻辑。法治督察工作机制有着深刻的作用机理,上下贯通的法治建设议事协调机构及其办事机构组成了其作用的组织依托,严厉问责、政治动员与典型通报构成了其作用的多元控制工具,目标驱动与问题驱动形成了其作用的动力机制。在推动中国式法治现代化的时代背景之下,法治督察工作机制需要从作用场域、公众参与、组织协同与数字赋能四个方面进行优化,从而形成体现本土特色的自主型法治进路。

The mechanism of rule of law supervision is a distinctive institutional arrangement in the construction of rule of law in China.The working mechanism of rule of law supervision has a profound mechanism of action,with the interconnected legal construction deliberation and coordination institutions and their administrative agencies forming the organizational support for its role.Strict accountability,political mobilization,and typical reporting form its diverse control tools,and goal driven and question driven forms its driving mechanism.In the context of promoting the modernization of the“Chinese style rule of law”era,the mechanism of rule of law supervision needs to be optimized from four aspects:scope of action,public participation,organizational collaboration,and digital empowerment,in order to form an“autonomous rule of law approach”that reflects local characteristics.
