权利视域下养老服务法权结构研究

Research on the Legal Structure of Elderly Care Services from the Perspective of Rights

养老服务作为积极应对老龄化的重要内容,已成为党和国家关切的议题。研探养老服务法的源头,明晰养老服务法的基础概念和权利属性,从价值理性和工具理性的视角剖析养老服务法的价值取向,进而衍生出养老服务法的法权结构。养老服务法律制度、法律原则、法律关系构成其法权结构。其中,法律原则是核心结构,法律制度是主体结构,法律关系是基本结构。养老服务法应以平等权为指引,以服从和服务于老年人生活需求,改善老年人的生活条件和生存状况为基本价值理念,构建养老、孝老、敬老和实现老龄事业与产业可持续发展的价值体系。

As an important part of actively responding to the aging population,elderly care services have become a topic of concern for the Party and the country.The source of the elderly care service law is explored,the basic concept and right attributes of the elderly care service law are clarified,the value orientation of the elderly care service law is analyzed from the perspective of value rationality and tool rationality,and then the legal structure of the elderly care service law is derived.The legal system,legal principles and legal relationship of elderly care services constitute the legal structure.Among them,the legal principles are the core structure,the legal system is the subject structure,and the legal relationship is the basic structure.The elderly care service law should be guided by the right to equality,follow and meet the living needs of the elderly,improve the living conditions and qualities of the elderly as the basic value concept,and build a value system of elderly care,filial piety,respect for the elderly,and a sustainable development of the elderly cause and industry.
