涉外刑事诉讼翻译活动的现状、问题与展望——基于960份裁判文书的实证分析

Current Situation,Problems and Prospects of Translation and Interpretation for Foreign-related Criminal Procedure--An Empirical Analysis of 960 Judgment Documents

从对960份涉外刑事诉讼裁判文书的分析来看,涉外刑事诉讼翻译活动具有主体以来自翻译公司的译员居多,服务对象以越南等国的被告人为主,有关案件以偷越国(边)境占比较大等特点。其存在的问题是绝大多数翻译人员存在缺乏资质、中立性不足,翻译程序不到位等。解决上述问题,要以市场为导向,在高校协同下培养复合型人才;加强建章立制和特色培训,发挥翻译服务机构重要作用;公检法机关当好涉外刑事诉讼翻译“把关人”;加大技术投入,政府要全力扶持人才培养工作。

From the analysis of 960 foreign-related criminal litigation judgment documents,it can be seen that the main body of for-eign-related criminal litigation translation activities is mainly the translator from translation companies,and the service target is mainly the defendant from Vietnam and other countries.The relevant cases are characterized by a relatively large proportion of ilgal border-crossing.The existing problems are that the vast majority of translators lack qualifications,lack neutrality,and inadequate translation procedures.To solve the above problems,it is necessary to take the market as the guidance and cultivate compound talents under the cooperation of universities;Strengthen the establishment of regulations and characteristic training,and exert the important role of translation service institutions;Public security organs,procuratorates,and law enforcement agencies should be the"gatekeepers"of translation in foreign-related criminal procedure;Increase technological investment,and the government should fully support talent culti-vation.
