摘要
新西兰土著毛利人的知识产权保护制度与西方不同,具有一定的典型性。新西兰目前的知识产权制度可以为之提供一定保护,但仍不够充分。国内方面,Wai262报告不具有强制约束力,仅具有象征意义和政治意义;国际方面,已有明确条款规定,但比较分散且作用有限。毛利人的知识产权保护仍面临数据保护制度不完善和不能完全适用国内版权法、商标法等问题。因此,可以从完善土著数据主权、由毛利人带头制定相关法案和增强法律适用的弹性等方面逐步充实土著人的知识产权保护制度。
The intellectual property protection system for Maori,the indigenous people of New Zealand,has distinctive characteristics that differ from traditional Westerm frameworks.While New Zealand's current intellectual property system can provide protection,its de-gree remains inadequate.Domestically,the Wai262 report,which serves only symbolic and politial purposes,lacks binding authority.In-termationally,clear provisions exist but are dispersed and have limited effectiveness.Maori intellctual property protection still faces chal-lenges such as the incomplete data protection system and the inability to apply domestic copyright and trademark laws.Therefore,the intel-lectual property protection system for Maori can be strengthened by enhancing indigenous data sovereignty,enabling Maori to work on rele-vant bills,and increasing flexibility in legal applications.
