检察大数据赋能法律监督的探索与创新

Exploration and Innovation of Procuratorial Big Data Enabling Legal Supervision

检察大数据赋能法律监督是指检察机关以法律监督提质增效为目的,以合法合规的大数据技术为手段,通过树立大数据思维、汇集大数据资源、构建大数据模型、开展大数据分析的方法,运用大数据办案,依托大数据治理的工作模式。目前,各地探索主要以“办案辅助与数据集成”的贵州模式、“场景应用与数据集成”的浙江模式、“数据集成”的上海模式最为典型。通过考察发现,实践中检察大数据仍然存在归集共享成效有限、建模质量水平不高、分析研判能力弱、治理能力意识不强等问题,建议在数据归集、数据建仓、数据研判、数据治理方面采取针对性措施予以完善。

Procuratorial big data enabling legal supervision refers to the working mode of using big data to handle cases and relying on big data governance,with the purpose of enhancing legal supervision and the means of big data technology,by setting up big data thinking,gathering big data resources,building big data model and carrying out big data analysis.At present,the most typical models are Guizhou model of"case-handling assistance and data integration",Zhejiang model of"scene application and data integration",and Shanghai model of"data integration".Through investigation,it is found that there are still some problems in the practice of procuratorial big data,such as limited effectiveness of collection and sharing,low quality of modeling,weak ability of analysis and judgment,and weak awareness of governance ability.It is suggested to take targeted measures in the aspects of data collection,data warehouse building,data research and judgment,and data governance to improve them.
