论中国法学版图的变迁

On the Changes of China's Legal Landscape

为了加快构建中国特色法学学科体系、学术体系、话语体系,有必要把握中国法学版图的变迁。根据中国不同历史时期的法学格局,可以绘制出不同的中国法学版图。中国的法学格局在数千年间几经变化,先后生成了五张历时性的法学版图。根据先秦时期的法学格局,可以绘制出第一张法学版图,其间,儒墨道法相互竞争,是为多元化时代的法学版图。根据从汉至清的法学格局,可以绘制出第二张法学版图,其间,经学、礼学、律学功能各异、相互补充,是为儒家化时代的法学版图。根据20世纪上半叶的法学格局,可以绘制出第三张法学版图,其间,西方法理学居于基础地位,偏重于英美的公法学与根植于欧陆的私法学为那个时代的“六法全书”提供了学理支撑,是为西方化时代的法学版图。根据20世纪50至70年代的法学格局,可以绘制出第四张法学版图,其间,苏联法理学居于基础地位,源于苏联的宪法学、民法学、刑法学构成了部门法学的主体部分,是为苏联化时代的法学版图。根据20世纪80年代以来的法学格局,可以绘制出第五张法学版图,是为自主化时代的法学版图,其间,中国特色社会主义法理学占据了基础地位,与此同时,日渐丰富的传统部门法学与新兴交叉法学相互协调,为中国特色社会主义法学学科体系、学术体系、话语体系的构建展示了广阔的空间。

In order to accelerate the construction of a discipline system,academic system,and discourse system with Chinese characteristics,it is necessary to grasp the changes in the Chinese legal landscape.In the pre Qin period,it was creating a legal landscape for a diversified era.From the Han Dynasty to the Qing Dynasty,it was making it the legal landscape of the Confucian era.In the first half of the 20th century,it was the legal landscape of the Westernized era.From the 1950s to 1970s,it was the legal landscape of the Soviet era.Since the 1980s,which was the legal landscape of the era of autonomy.Socialist jurisprudence with Chinese characteristics has taken a fundamental position.The coordination between increasingly rich traditional departmental jurisprudence and emerging interdisciplinary jurisprudence has shown broad space for the construction of the discipline system,academic system,and dis-course system of socialist jurisprudence with Chinese characteristics.
