《消费者权益保护法》视域下的医疗服务纠纷救济路径应当分类探讨。各省市地方立法规范性文件采不同观点,分析阐论各观点之代表性地方法规规范设置动因和可行性、可控性。地方立法中医疗服务的消法分类保护逻辑为尚未明确该问题的全国性消法实施规范提供了启示和可行方案。将医疗服务分类为医疗美容服务、药品经营服务、一般性医疗服务和关怀性医疗服务,阐释不同类型医疗服务所应当受到的消法保护力度,并尝试提出适当立法建议和规制途径。

The relief path of medical service disputes under the perspective of the Law on the Protection of Consumer Rights and Interests should be discussed in different categories.The local legislative normative documents of provinces and cities should adopt different views,and the motivation,feasibility and controllability of the representative local regulations should be analyzed.The classified protection logic of the consumer law of medical service in local legislation provides enlightenment and feasible scheme for the implementation standard of the national consumer law which has not yet been clarified.The medical service is classified into medical cosmetology service,drug management service,general medical service and caring medical service,explaining the protection that different types of medical service should be protected,and trying to put forward appropriate legislative suggestions and regulatory channels.
