The Emotional,Rational and Legal Logic of Political Party Consultation with Chinese Characteristics

政党协商在西方各国处理政党关系上是一种稀缺的政治实践,同时,西方学术界也很少关注政党协商。与之形成鲜明对比的是,政党协商在中国则有着丰富且制度化的实践形式,并在此基础上形成了自己独特的运行逻辑:基于政党间友谊之上“以心交心”的情感逻辑,它是中国特色政党协商有序开展的情感基础;基于根本政治共识、围绕公共利益进行协商的理性逻辑,它是中国特色政党协商能够做出明智决策的认识论保证;党政体制下以宪法和党章为最高依据的法理逻辑,它超越了国家法中心主义的法治观,是中国特色政党协商可持续开展的制度化保证。中国特色政党协商的成功实践对于拓宽协商民主的理论视野、对于世界各国处理政党间关系都具有重要的借鉴意义。

Political party consultation is rarely practiced in dealing with political party relations in Western countries,and has received little attention in Western academia.In sharp contrast,political party consultation in China has rich and institutionalized practical forms,based on which it has formulated its own unique operating logic.The emotional logic of“heart-to-heart”based on friendship between political parties is the emotional basis for the orderly development of political party consultation with Chinese characteristics;the rational logic of fundamental political consensus and consultation around the public interest is the epistemological guarantee that the Party can make wise decisions through political consultation with Chinese characteristics;and the legal logic of taking the Constitution and the Party Constitution as the supreme basis under the system,in which the Party and the governments working together,transcends the state-centric rule-of-law orthodoxy and is an institutionalized guarantee for the sustainable development of political party consultation with Chinese characteristics.The successful practice of political party consultation with Chinese characteristics has provided important reference for the rest of the world in broadening the theoretical perspective of consultative democracy and dealing with relations between political parties.
