Study on the misunderstanding of the application of the “Three Step Method” ininvention patents from the perspective of patent invalidation declaration

中国发明专利的创造性判断遵从“三步法”原则,但在运用“三步法”判断专利的创造性时,普遍存在误区。例如,在区别技术特征是否被对比文件公开及其作用是否与其在对比文件中的作用相同、本领域技术人员是否有动机去将多篇对比文件进行结合方面,往往会把握不准。文章引入经过专利无效宣告程序的典型实例来剖析在运用“三步法”时经常出现的问题,为如何正确运用“三步法”判断专利的创造性提供了思路和方向。

The creative judgment of Chinese invention patents follows the“Three Step Method”principle,but there are generally some misunderstandings when using the“Three Step Method”to judge the creativity of patents.For example,when it comes to distinguishing whether technical features are publicly disclosed in the comparative documents and whether their role is the same as that in the comparative documents,and whether technical personnel in this field have the motivation to combine multiple comparative documents,they often may not be sure.This article will introduce typical examples of patent invalidation procedures to analyze the problems that often arise when using the“Three Step Method”,which provides ideas and directions for how to correctly use the“Three Step Method”to judge the creativity of patents.
