On the Compensation System for Divorce Damages

自2001年《婚姻法》颁布以来,离婚损害赔偿制度在司法实践中的适用效果不佳,法院支持受害人的判决比例较低。《民法典》的横空出世,也开启了离婚损害赔偿制度的新纪元。通过对离婚损害赔偿制度的构成要件进行分析,找出实务中存在的问题,并提出相应的对策,更好地维护了当事人的合法权益,最终影响整个社会对离婚损害赔偿制度认可。

Since the promulgation of The Marriage Law in 2001,the application effect of the divorce damage compensation system in judicial practice has been poor,and the proportion of court judgments supporting victims is relatively low.The emergence of The Civil Code also ushered in a new era of divorce damages compensation system.By analyzing the constituent elements of the divorce damage compensation system,identifying the problems that exist in practice and proposing corresponding countermeasures,the legitimate rights and interests of the parties are better protected,ultimately affecting the recognition of the compensation system for divorce damages by the entire society.
