数据的权属场域与规制逻辑

随着数字技术对信息存储样态的转变,数字空间产生了与物理空间完全不同的时空场域。数据权属的研究需要借助社会学者布迪厄提出的场域分析方法视角,进而从抽象法律关系的角度重新审视数据独有的权属场域逻辑。研究发现:多维空间的数据无法实现支配控制的财产属性,需要以功能主义为研究方法重新审视数据财产法律关系;数据并不具有完全删除或是传统物权中处分权能的法律关系特性,但具有还原至某一特定时间状态多维时间的独有关系特征;数据权利的研究需要引入多维时空关系——科学理性与法律理性双向交织的场域分析方法,进而形成“状态型”研究向“关系型”研究的理论范式转换。状态型研究为数据财产研究提供了更加灵活动态的理论视角,使得研究方法与社会变革具有更强的系统兼容性。

With the transformation of information storage patterns by digital technology,digital space has created a completely differ-ent spatio-temporal field from physical space.The study of data tenure requires the help of sociologist Boody.The study of data ownership needs to reexamine data from the perspective of abstract legal relationship by using the perspective of field analysis proposed by sociologist Bourdieu.The study of data tenure needs to reexamine the logic of the unique tenure field of data from the perspective of abstract legal rela-tions.It is found that data in multidimensional space cannot be dominated.The study finds that:data in multidimensional space cannot achieve the property property property of domination and control,which requires a functionalist approach to re-examine the legal relation-ship of data property;data do not have complete.The data does not have the characteristics of the legal relationship of complete deletion or dispositive power in traditional property rights,but has the characteristics of the unique relationship of reduction to a specific time state in multidimensional time.The study of data rights requires the introduction of a multidimensional spatiotemporal relationship-a field analysis method that interweaves scientific rationality and legal rationality,in order to form a theoretical paradigm shift from“state based”research to“relational”research.State based research provides a more flexible and dynamic theoretical perspective for data property research,making research methods more systematic and compatible with social change.
