On the Court Review Mode of Criminal Compliance in the New Era

我国的企业刑事合规改革是在习近平法治思想指引下开展的,人民法院正积极探索参与改革。企业犯罪暂缓起诉制度作为我国改革的借鉴对象,可以分为法院程序审查模式和法院实质审查模式,二者均以法院司法审查权制约检察机关的自由裁量权。司法为民是我国法院审判权的本质属性,为了实现公诉权与审判权的平衡,应当赋予人民法院对企业合规案件开展实质性审查的权力。构建适用于非轻微经济类企业犯罪案件的“企业合规撤回起诉程序”,由法院进行实质审查,在通过检察机关的延期审理申请并决定中止审理后,合规考察才正式启动,相关工作以“检察主导+法院监督”的方式开展,最终由法院对“真合规”的案件裁定准许撤回起诉。

China's corporate criminal compliance reform is carried out under the guidance of Xi Jinping's thoughts on the rule of law.The people's courts are actively exploring participating in the reform.As a reference for the reform of our country,the system of deferred prosecution of enterprise crimes can be divided into the mode of court procedure review and the mode of court substance review,in both cases,the judicial review power of the court restricts the discretionary power of the procuratorial organ.Justice for the people is the essential attribute of the judicial power of Chinese courts.In order to achieve the balance between public prosecution power and judicial power,people's courts should be given the power to conduct substantive review of enterprise compliance cases.Establish the enterprise compliance withdrawal prosecution procedure applicable to non-minor economic enterprise crime cases,and the court will conduct substantive review,and the compliance investigation will be officially launched after the prosecution's application for trial extension and decision to suspend the trial is passed.The relevant work is carried out in the way of procurator-led+court supervision,and the court finally decides to withdraw the prosecution for the truly compliance cases.
