论盲盒交易行为及其法律规制思路

盲盒交易是市场经营主体遵循契约自由原则创设的新型交易。盲盒交易行为具有商品、机会双重交易对象属性特点。盲盒交易行为的特点既是其兴起的原因,也成为盲盒交易失序行为产生及对其进行法律规制的基础。根据盲盒交易的特点,盲盒交易失序行为包括与传统交易共有及特有两种类型。盲盒交易特有的失序行为表现为经营者诱导消费、异化盲盒交易为赌博行为、经营者滥用盲盒规避法定经营范围行为及经营者不合理定价等。为摆脱仅从行为表现角度对盲盒交易规制研究的浅层性,解决问题导向立法的适应性局限与重复立法问题,以共有和特有类型为规制制度适用的依据,对盲盒交易行为的法律规制思路是:与传统交易共有类型适用传统市场交易法律规范,盲盒交易特有失序行为根据其类型设置针对性的规制制度,引导盲盒交易健康有序发展。

Blind box trading is a new type of transaction created by market operators in the freedom of contract of the times.Blind box trading behavior has the characteristics of dual transaction object attributes of commodity and opportunity.The characteristics of blind box transaction are not only the cause of its rise,but also the basis of its legal regulation.According to the characteristics of blind box trad-ing,the disorder behavior of blind box trading includes two types:common and unique.The special disorder behavior of blind box trading is that the operator induces consumption,the alienation blind box is gambling,the operator abuses the blind box to avoid the legal business scope,and the operator makes unreasonable pricing.In order to get rid of the superficiality of the research on the regulation of blind-box transaction only from the perspective of behavior expression,and to solve the problems of the adaptability limitation of the problem-orient-ed legislation and the repeated legislation,the common and unique types are used as the basis for the application of the regulation system,the idea of legal regulation of blind box trading is that the traditional market transaction law should be applied to the common type of blind box transaction,and the specific disorder behavior of blind box transaction should be regulated according to its type,to guide the healthy and orderly development of blind box trading.
