经济法视阈下乡村振兴战略面临的困境及法律完善研究

Study on the Dilemma of Rural Revitalization Strategy and Legal Perfection from the Perspective of Economic Law

乡村振兴战略的实施关键在于消除城乡经济发展不均衡的局面,这与经济法以社会整体利益为目标的法制观念有着共同的理念。从经济法与乡村振兴战略的内在联系、经济法保障原则与乡村振兴战略内涵的契合、经济法对乡村振兴战略的价值所在三个方面介绍了经济法对实施乡村振兴战略的价值和意义,从主体认定、激励方式和资金管理三个维度分析了经济法视阈下乡村振兴战略面临的困境。经济法视阈下乡村振兴战略法律完善的建议包括主体制度层面、激励机制层面和资金管理层面,在经济法视阈下还要完善政府主体制度、市场主体制度和乡村经济主体制度,优化经济法激励机制、建立以结果为导向的考核机制、进行乡村振兴激励机制的长远规划。通过经济法的完善拓宽乡村振兴的资金来源、规范乡村振兴资金的应用制度、加强对乡村振兴资金的监督。

Implementing the rural revitalization strategy lies largely in eliminating the imbalance between urban and rural economic growth,in agreement with the legal concept of economic law aimed at the overall interests of society.An introduction is made about the value and significance of economic law for implementing the rural revitalization strategy in three aspects:the internal relationship between economic law and the rural revitalization strategy,the correspondence between the protection principles of economic law and the connotation of the rural revitalization strategy,and the value of economic law to the rural revitalization strategy.Then an analysis is given of the difficulties confronting the rural revitalization strategy from the perspective of economic law in terms of three dimensions:subject identification,incentive methods and fund management.Finally,suggestions are presented about legal perfection of the rural revitalization strategy from the perspective of economic law,which involve improving the main system,the incentive mechanism and the fund management.In view of economic law,it is necessary to improve the main body systems of government,market and rural economy respectively,optimize the incentive mechanism of economic law,establish the outcome assessment mechanism,and make long-term plans of the rural revitalization incentive mechanism.A perfect economic law is an effective way of expanding the source for the rural revitalization fund,standardizing the application system of the rural revitalization fund,and strengthening the supervision of the rural revitalization fund.
