基于标准化的企业行政合规浅析

Analysis of Enterprise Administrative Compliance Based on Standardization

以行政压力为主导的企业合规推进方式、激励机制落实不健全或缺失,行政监管部门和检察机关之间缺乏沟通协调机制以及合规管理体系建设缺乏规范性等问题都不同程度制约着我国合规管理的发展。随着涉案企业合规改革的持续深化,离不开行政监管部门的全面配合。要继续深化改革,需要在行政合规管理方面进行优化。对此,本文在分析合规管理体系标准的作用基础上,提出了通过标准化支撑加强企业行政合规指导工作的建议。为了确保加强企业行政合规指导工作建议落到实处,梳理和总结了国内合规管理现状及存在的问题,分析了合规管理体系标准的作用,并提出通过标准化落实加强企业行政合规指导工作的建议。

Problems restraining the development of administrative compliance in China include the promoting method of enterprise compliance led by administrative pressure,imperfection or absence of implementation of incentive mechanism,lack of communication and coordination mechanism between administrative supervision departments,lack of standardization in the construction of compliance management system,etc.With relevant enterprises continuously deepening the compliance,it is of great importance for administrative supervision departments to fully cooperate.To continuously deepen reform,it is necessary to optimize administrative compliance management.Therefore,based on the analysis of the role of standards on compliance management system,the paper puts forward some suggestions to strengthen the administrative compliance guidance of enterprises via standardization.In order to ensure the implementation of the suggestions on strengthening the administrative compliance guidance of enterprises,this paper sorts out and summarizes the current situation and existing problems of domestic compliance management,analyzes the role of standards for compliance management system,and puts forward suggestions on strengthening the administrative compliance guidance of enterprises through standardization.
