非法使用社保卡行为的刑法适用问题研究

Research on the Application of Criminal Law to the Illegal Use of Security Cards

鉴于社保卡的金融功能和社保功能各自独立,金融账户和社保账户间的资金不能互相流转、划拨,可以按照所涉资金性质或者账户不同,并结合参保人员、社会保险经办机构工作人员、定点医药机构及其工作人员的行为性质,对不同主体非法使用社保卡的行为,分别适用信用卡诈骗罪、盗窃罪、诈骗罪和盗用身份证件罪追究法律责任。

Given that financial and social security functions of security cards are both independent,funds in financial accounts and security accounts cannot be remitted or transferred to each other.Depending on the nature of the funds involved or the accounts involved,and taking into consideration the previous nature of the behaviors of insured personnel,staff of social insurance agencies,designated medical institutions,and their staff,judicial officers can define related subjects'illegal use of security cards as credit card fraud,theft,and fraud or identity card theft and ask them to assume relative legal responsibility.
