当代社会管理中程序弹性的困境及对策

The Dilemma and Countermeasures of Procedural Flexibility in Contemporary Social Management

我国目前的社会关系是在历史文化底蕴中形成的具有中国特色的人情社会。谦和包容的人情社会为中国法治建设提供了和谐稳定的社会基础,弥补了以资本为主导的市场经济体制的不足,但是人情社会管理中的程序规则意识也随着社会的发展而发生变化。因人情社会中“人情”的困扰,程序规则出现肆意弹性化,严重违背了程序公平正义原则。在推动我国法治化建设的进程中,本文试图从完善监督体制、培养法治观念、规范权力运行等方面积极规避人情社会程序弹性导致的风险,寻找适合中国国情的程序正义之路。

China's current social relationships have evolved within a historical and cultural context,resulting in a unique Chinese-style human society.This harmonious and inclusive huamn society serves as the foundation for China's legal construction,compensating for the shortcomings of a market economy system primarily driven by capital.However,the awareness of procedural rules in interpersonal society management has evolved with societal development.Due to the challenges posed by the"human sentiment"nature of this society,procedural rules have become overly flexible,seriously violating the principles of procedural fairness and justice.In the process of promoting the rule of law in China,this paper attempts to actively address the risks associated with the flexibility of procedural rules in human society,such as improving the supervisory system,fostering a legal consciousness,and regulating the exercise of power,while seeking a path towards procedural justice that suits China's national conditions.
