未成年人“两法”实施中的检察监督责任研究

Research on Procuratorate's Supervision Liability in the Implementation of "Two Laws" for Minors

新修《中华人民共和国未成年人保护法》《中华人民共和国预防未成年人犯罪法》(以下简称未成年人“两法”)中规定了未成年人检察公益诉讼、督促和支持起诉、检察建议、训诫等检察监督方式。但因存在未成年人检察监督线索来源不畅、部分监督方式刚性不足、诉讼监督模式制约监督能动性、未成年人“两法”检察监督方式不足等问题而影响了检察监督的质效。对此,提出了拓宽监督线索来源、借助外力赋予监督刚性、探索行政执法活动的非诉讼检察监督以及加强对未成年人“两法”检察监督方式的能动探索等建议,以期益于未成年人检察监督工作的质效提升。

The lately revised Law of the People's Republic of China on the Protection of Minors and the Law of the People's Republic of China on the Prevention of Juvenile Delinquency(hereinafter referred to as the"Two Laws"for Minors)provide for procuratorial supervision methods such as public interest litigation,urging and supporting prosecution,procuratorial suggestions,and admonishment for minors.However,the quality and effectiveness of procuratorial supervision are affected by problems such as poor source of clues,less rigid supervision methods,the restriction of litigation supervision mode on initiative of supervision,and insufficient methods adopted in supervision on the implementation of"Two Laws".In this regard,this paper suggests broadening the clue sources of supervision,improving the rigidity of supervision with the aid of external forces,exploring the non-litigation procuratorial supervision on activities of administrative law-enforcement and procuratorial approaches to supervise"Two Laws"for minors,so as to improve the quality and efficiency of the procuratorial supervision related to minors.
