群众史观视域下公安机关侦查法治化路径:三元逻辑

Rule-of-Law Paths in Public Security Organs' Investigation from the Perspective of Mass Historical View: Triadic Logic

当前公安机关打击涉网犯罪的成效有限,证据制度亦发生了较多调整和完善;在中国共产党领导下的人民警察工作中,公安工作群众路线是对马克思主义历史观、认识论的具体运用。结合党的二十大精神,侦查研究应遵循三元逻辑,即以“群众史观”作为价值遵循,以诉讼法作为发展框架,以调查研究作为基石,推动侦查法治化发展,服务于公安改革和预防警务实践。

Currently,public security organs'achievements in cracking down cybercrimes are limited,and the evidence system has also undergone significant adjustments and improvements.Under the leadership of the Communist Party of China,the people's police adhere to the mass line in public security work,which is the specific application of Marxist historical views and epistemology.Guided by the spirit of the 20th National Congress of the Communist Party of China,this study discusses the research on criminal investigation should follow the triadic logic,that is to follow the"mass historical view"as the value,take the procedural law as the development framework,and regard investigation and research as the cornerstones to promote the development of investigation under the rule of law,thus serving public security reform and preventive policing practice.
