非法鉴定胎儿性别行为之刑事规制的困境及路径优化

On Criminal Regulation Dilemma and Its Improving Measures of Illegal Fetal Sex Identification

我国现行法律明文禁止非医学需要的胎儿性别鉴定,因其妨害了我国的人口生育及其管理秩序,影响胎儿父母选择进而危及胎儿生命权,并在一定程度上增大了胎儿性别失衡、引发社会乱象的产生;分析医疗领域相关的行政手段乏力和刑事规制实属空白的现状,借鉴韩国、我国台湾地区等的立法经验,我国刑法可增设“非医学需要胎儿性别鉴定罪”,同时明晰管辖权问题、在程序上配以适当的侦查手段。

The current Chinese law explicitly prohibits the non-medical fetal sex identification,because it in-terferes with Chinese population reproduction and management order,affects the choice of fetal parents and endan-gers the fetus’right to life,increases the gender imbalance of the fetus to a certain extent,and leads to the genera-tion of social chaos.This paper analyzes the current situation of the lack of administrative means and criminal regula-tion in medical field,draws on legislative experiences of South Korea and Taiwan,and suggests that China's criminal law add"non-medical fetus sex identification crime",jurisdiction right be cleared at the same time,and properly use investigative means in the procedure.
