虚假诉讼罪实体与程序疑难问题研究

Studies on the Substantial and Procedural Difficult Issues of the Crime of False Litigation

本文从实体与程序两个维度,深入分析了虚假诉讼罪司法适用中存在的若干疑难问题。对于“部分篡改型”虚假诉讼行为,应当区分具体情形,将严重扰乱司法秩序的“部分篡改型”虚假诉讼行为纳入刑法惩治范围之内;虚假诉讼罪与以骗取财物为目的诉讼诈骗犯罪行为通常呈现为想象竞合关系。对于虚假诉讼罪的认定,要结合不同的民事诉讼程序进行,当事人在民事一审程序、二审程序或者申请再审程序中捏造事实的,都可能构成虚假诉讼罪;在《民事诉讼法》及《刑法》都针对虚假诉讼作出规定的情况下,有必要通过两者的衔接对虚假诉讼形成体系化的规制。虚假诉讼罪案件处理应当畅通案件流程管理,加强公检法各部门分工配合。

This article provides an in-depth analysis of several difficult issues in the judicial application of the crime of false litigation from substantive and procedural dimensions.For"partial tampering"false litigation behavior,specific circumstances should be distinguished,and"partial tampering"false litigation that seriously disrupts judicial order should be included in the scope of criminal punishment;the crime of false litigation and the crime of litigation fraud for the purpose of defrauding property usually present an imaginary concurrence.The determination of the crime of false litigation should be carried out in conjunction with different civil litigation procedures,and if the parties fabricate facts in the civil first-instance procedure,second-instance procedure or application for retrial procedure,it may constitute the crime of false litigation;in the case where both the Civil Procedure Law and the Criminal Law provide for false litigation,it is necessary to establish a systematic regulation of false litigation through the connection between the two laws.The handling of the cases of crime of false litigation should facilitate the management of case processes and strengthen the division of labor and cooperation among various departments of public security,procuratorate and court.
