破产公共服务供给的本土化重构--以世行营商环境供给商事破产“公共服务”指标为视角

Localized Reconstruction of Bankruptcy Public Service Supply--From The Perspective of The Business Insolvency“Public Service”Index in The World Bank's B-ready

破产公共服务供给是基本公共服务体系的关键一环。营商环境供给商事破产“公共服务”指标为破产公共服务既指明了数字化、专业化的硬件设施配套,也提出了以社会效益为要义的软件制度改造。我国破产公共服务供给存在供给低效、质量欠佳、配置失衡等供给梗阻,应当树立破产公共服务治理的系统论思维,对破产公共服务基础设施采取工具性批判,注重破产公共服务供给的范式转换,为我国破产公共服务供给本土化重构提供底层思维。应当以破产衍生业态发展为契机激励破产数字公共服务,以破产审判质效跃升为宗旨完成破产审判专门机构的进阶,设计综合考评体系适配管理人职业化的路径,配置破产服务局以健全破产行政协调机制。

Bankruptcy public service supply is a key part of the basic public service system.The"B-ready"business insolvency"public service"index not only points out the digital and professional hardware facilities for bankruptcy public services,but also proposes the transformation of software system with social benefits as the key.China's bankruptcy public service supply has supply obstructions such as inefficient supply,poor quality,and unbalanced allocation,and should establish systematic thinking on bankruptcy public service governance,adopt instrumental criticism of bankruptcy public service infrastructure,pay attention to the paradigm shift of bankruptcy public service supply,and provide underlying thinking for the localization reconstruction of bankruptcy public service supply in China.The development of bankruptcy derivative business should be taken as an opportunity to stimulate bankruptcy digital public services,complete the advancement of bankruptcy trial specialized institutions with the purpose of leaping the quality and efficiency of bankruptcy trials,design a comprehensive evaluation system to adapt the path of professionalization of administrators,and set up a bankruptcy service bureau to improve bankruptcy administrative coordination mechanisms.
