数字检察的生成逻辑、实践范式与发展面向

The Generation Logic,Practice Paradigm,and Development Orientation of Digital Prosecution

数字检察虽然处在智慧检务的发展延长线上,但两大战略工程的驱动逻辑、工作重心和终极目标均不相同。检察权在发展中不断调整其权力外延和运行方式,努力实现检察权发展与国家治理的同频共振是推动智慧检务转向数字检察的根本原因。数字检察之所以呈现出大数据赋能法律监督的实践样态,根源于深入贯彻数字中国与法治中国战略、以大数据为关键变量重塑法律监督体系与在推进数字法治进程中实现数字正义的制度逻辑。数字检察的实践范式突出表现为个案办理中的“线索识别”,类案监督中的“贯通效应”和系统治理中的“监督价值”。当前,数字检察仍处在发展初期,需要在技术上解决其“生产资料”和“生产技术”问题,在制度上要通过职能“融合”和部门“多跨”建立起适应数字检察的工作模式与体制机制,在理论上加强数字检察基本概念与基础理论的研究,构建专门理论、制度和话语体系,以理论的沉淀与创新为数字检察战略提供清晰的方法论指引。

Although digital prosecution is based on the development of intelligent prosecution,the two strategic projects have different driving logic,work priorities,and ultimate goals.The constant adjustment of power outreach and mode of operation of the procuratorial power and efforts to achieve the development of the procuratorial power and its resonance with national governance are the fundamental reason for promoting intelligent prosecution services to digital prosecution.The digital prosecution,demonstrating the empowerment of legal supervision through big data,stems from the in-depth implementation of the Digital China and Rule of Law China strategies,the reshaping of legal supervision with big data as the key variable,and the institutional logic of digital justice in promoting the digital rule of law.The digital prosecution practice paradigm mainly involves the"identification of clues"in case processing,the"linking effect"in case supervision and the"supervision value"in system governance.At present,the digital prosecution is still in the early stage of development,and therefore,we need to settle many problems such as technological issues related to"production materials"and"production technology".In terms of institutional development,we need to establish a working model and systemic mechanism that are conducive to digital prosecution by virtue of functional"integration"and"cross-sectoral"collaboration.Theoretically,we need to strengthen the research on the basic concepts and theories of digital prosecution,and build specialized theories,systems and discourse systems to provide clear methodological guidelines for digital prosecution strategies through theoretical basis and innovation.
