论新时代法德结合共治之道

On the Principle of Combining Law and Morality for A Shared Governancein the New Era

法德相互结合与法德兼治、共治,是新时代中国共产党极为重视的治国理政之道。法治与德治虽然都是国家的治理方式,但它们各自具有不同的作用与功能,二者各存其局限性。只有把法律与道德各自的功能有机结合起来,以法律调整人的外在行为,以道德教化人的内心,二者相互辅助、相辅相成,才能相得益彰,做到内外兼治,从根本上治理好国家和社会。从历史和实践维度观之,法德结合共治既是中外历史经验的总结,更是中国共产党对治国理政规律的深刻把握,对于新时代中国共产党治国理政具有重大的历史与现实价值。要真正实现法德结合共治,方法与有效路径有三:第一,发挥道德教化的功能,使道德教育与法治教育相结合;第二,以法治承载道德,以法治保障道德;第三,强化领导干部在法治与德治中的关键作用。

The combination of law and morality and the co-governance of law and morality are the ways of governance to which the Communist Party of China(CPC)attaches great importance to in the new era.Although rule of law and rule of morality are both ways of governing a country,they each have different roles and functions with its own limitation.Only by organically combining the functions of law and morality,adjusting people's external behavior with law,and cultivating people's inner self with moral education can the two complement each other,achieving both internal and external governance,and fundamentally governing the country and society.From the perspective of history and practice,combining law and morality for a shared governance reflects not only the summary of historical experience home and abroad,but also a profound grasp of the CPC's laws of govermance.It has great historical and practical value for the ruling party in the new era.There are three methods and effective paths to truly combining law and morality for a shared governance:firstly,to play the role of moral education and combine moral education with legal education;Secondly,to carry morality with the rule of law and safeguard morality with the rule of law;Thirdly,to strengthen the key role of leading cadres in the rule of law and moral governance.
