“双碳”目标下我国低碳技术法律原则的塑造

The Shaping of the Legal Principles of Low Carbon Technology under theTargets of Carbon Peaking and Carbon Neutrality

低碳技术在“双碳”目标的实现中具有核心支撑的作用。为因应“双碳”目标和低碳技术发展的要求,在“双碳”和低碳技术法律制度中应确立相应的低碳技术法律原则。基于技术性、低碳性和法律性的考量,可确立如下一些低碳技术法律原则:体现可持续发展理念的可持续发展原则;符合低碳技术发展规律的合乎规律原则;鼓励低碳技术创新的创新原则;为防范或降低风险的风险预防原则;促进低碳技术研发与应用的政府干预与市场调节相结合原则;体现低碳技术国内内部联合与国际合作的合作原则;实现低碳技术与相关新技术、生态环境协调发展的协同原则。这些原则构成了一个完备、有机统一的低碳技术法律原则体系,共同塑造了低碳技术法律制度的内容与方向,这些原则不仅应体现在低碳技术法律制度的设计中,而且也应在法制实施中得到遵循。

The low carbon technology plays a core role in the realization of the“double carbon”targets.In order to meet the“double carbon”targets and the requirements of the development of low carbon technology,the corresponding legal principles of low carbon technology should be established in the legal system of“double carbon”and the low carbon technology.Based on technical,low-carbon and legal considerations,the following legal principles of low-carbon technology can be established:Sustainable development principle that embody the concept of sustainable development;Principle which comply with the law of low-carbon technology development;Innovation principle that encourage innovation in low-carbon technologies;Risk prevention principle to prevent or reduce risks;The principle of combining government intervention and market regulation promoting the development and application of low-carbon technologies;Cooperating principle which embody the low carbon technology domestic internal joint and the international cooperation;Principle of synergy that to realize the coordinated development of low-carbon technologies,related new technologies and ecological environment.These principles should not only be reflected in the design of the low-carbon technology legal system,but also be followed in the implementation of the legal system.
