数字化叠加老龄化催生了老龄人在数字领域的“失能”问题,甚至已经影响到了老龄人的适当生活水准。如何让老龄人群体充分享有数字权益是实现社会公平的重要组成部分。面对老龄人遭遇数字不平等、数字贫困、数字排斥等数字权益保障不足问题,不仅需要依靠老龄人自身能力培养、所在家庭代际反馈以及市场的自发运作,更需要通过强化国家责任,从提升老龄人数字技术应用能力、完善法律制度体系、加强物质与技术保障和发挥司法保护职能等方面构建法治化保障路径。

The superposition of digitization and aging is an important practical problem in Chi-na's current society.The digital poverty and exclusion faced by the elderly population have already affected their enjoyment of digital rights.Elderly people need to enjoy digital rights in order to fully integrate into society,achieve inter-generational equity,and ensure the appropriate standard of liv-ing that should be achieved in the digital age.Faced with the problem of insufficient digital rights protection for elderly people,relying solely on the"feedback"of the elderly themselves and their families,as well as the spontaneous operation of the market,is not enough to achieve the goal of full protection.To this end,it is necessary to strengthen the country's responsibility for ensuring the rule of law,and build a path of legal protection from aspects such as enhancing the digital technology application ability of the elderly,improving the legal system,strengthening material and technologi-cal support,and exerting judicial protection functions.
