京津冀减污降碳“双”协同法治保障问题探析

摘要 京津冀区域是我国大气污染和温室气体排放的重点区域。“双碳”目标提出后,京津冀将面临更大的减排压力。将大气污染与温室气体协同治理可以提高减排效率、降低治理成本,为此京津冀可以引入跨区域与减污降碳的“双”协同治理思路。在立法层面,尽管三地已经初步建立起环境保护综合协调体制,以及大气污染联防联治的法律制度,但在“双碳”目标保障立法层面,三地却步调不一、协同不畅,更难为三地深度减污降碳“双”协同提供法治保障。为此,京津冀有必要从立法模式选择、关键性制度安排、保障性机制的建立探索三地减污降碳“双”协同的法治完善路径。 The Beijing Tianjin and Hebei region is a key area for air pollution and GHG emissions in China.After the proposal of the"30-60"goal,the three regions will face greater pressure to reduce emissions.Collaborative governance of atmospheric pollution and greenhouse gases can improve emission reduction efficiency and reduce governance costs.Therefore,the Beijing Tianjin and Hebei region can introduce a"dual"collaborative governance approach of cross regional air pollution and carbon reduction.At the legislative level,although the three regions have initially established a comprehensive coordination system for environmental protection and a legal system for joint prevention and control of air pollution,at the legislative level of ensuring the"30-60"goals,the three regions have not followed the same pace and coordination is not smooth,making it even more difficult to provide legal protection for"dual"coordination of deep pollution reduction and carbon reduction in the three regions.Therefore,it is necessary for three regions to explore the legal path of"dual"synergy of air pollution and carbon reduction through the selection of legislative models,key institutional arrangements,and the establishment of safeguard mechanisms.
