以短视频为例的自媒体时代版权侵权界定与规制

Study on the Definition and Regulation of Copyright Infringement in the We Media Era Using Video Clips as an Example

随着互联网的普及和信息技术的发展,自媒体发展迅速,随之而来的自媒体侵权现象愈发普遍,版权保护遇到全新挑战。特别是短视频版权侵权问题尤为严重,其中“洗稿”、素材侵权、未经许可传播影视作品片段为主要表现形式,对权利人造成损失的同时,也扰乱网络秩序和社会文化环境。文章以短视频为例,从短视频的含义与特性出发,通过分析自媒体时代短视频版权侵权的主要表现形式,从短视频独创性的认定、短视频二次创作侵权的界定以及对自媒体平台的归责等方面,探讨了短视频版权侵权的界定规则,提出了对短视频版权侵权行为进行规制的具体建议。

With the popularization of the Internet and the advancement of information technology,we media has been booming,which gives rise to frequent infringement cases and poses new challenges to copyright protection.In particular the copyright infringement of video clips,represented by cases of“article laundering”,video material infringement,and unauthorized dissemination of film and television clips.Such cases not only cause losses to the rights holders but also disrupt the network order and social and cultural environment.Hence,based on the connotation and characteristics of video clips,this paper aims to examine the main forms of video clips copyright infringement and explores the regulation of such cases in terms of recognition of originality,the definition of secondary creation infringement,and the attribution of responsibility to we media platforms,In the end,specific suggestions are put forward for regulating such cases.
