主体责任观下平台合规的进路优化

Optimization of Platform Compliance under the Perspective of Subject Responsibility

平台权力现象及其技术表征下的新型失范行为引发规制难题,预防式合规治理机制悄然兴起。合规是平台履行主体责任的基本形式。主体责任观下,政府在合规建设中应当实现角色转换,将行为模式从“威慑合规”转型为“激励合规”,平台则应将合规标准从原初“合乎法律”以规避风险上升到“合乎道德”以承担社会治理责任,进而克制当前合规实践中“平台工具化”及“合规形式化”的消极合规倾向。具体而言,可从深化平台合规激励机制、推进平台社会责任建设、平台权源重点合规监管三个层面对平台合规进路予以优化,以促使平台在合规建设中充分发挥主观能动性,承担自身社会治理的主体角色。

The phenomenon of platform power and the new types of misconduct characterized by its technology have caused regulatory difficulties,and preventive compliance governance mechanisms have quietly emerged.Regulation is the basic form of platform implementation of subject responsibility.Under the perspective of subject responsibility,the government should achieve a role transformation in compliance construction,transforming its behavior mode from"deterrence compliance"to"incentive compliance".Platforms should actively assume social governance responsibilities in compliance construction,and upgrade their behavior standards from"legal"to"ethical"to curb the current trend of"platform instrumentalization"and"compliance formalization"in negative compliance.Specifically,the platform's compliance approach can be optimized from three aspects:deepening the platform's compliance incentive mechanism,promoting the construction of platform social responsibility,and focusing on compliance supervision of platform rights,in order to encourage the platform to fully exert its subjective initiative in compliance construction and assume its main role in social governance.
