农民集体与农村集体经济组织的关系探析

明确农民集体与农村集体经济组织两者的关系,是农村产权制度改革首当其冲的任务。尽管在传统的民法理论中,农民集体并非法律形式上的权利主体,但实际上,他们是真正意义上的权利主体。农民集体和农村集体经济组织并非同一组织体,从两者的制度创建的价值取向、相关法律条文的体系解释和成员范围,都可以看出两者是不同的组织体。农民集体的资源性资产和公共性资产由农民集体的自治组织村民委员会管理,农村集体经济组织代其经营、管理农民集体的经营性资产。

Clarifying the relationship between farmers'collectives and rural collective economic organizations is the first task in the reform of rural property rights system.Although in the traditional civil law theory,the farmers'collective is not the subject of rights in legal form,but in fact,they are the real sense of the subject of rights.Farmers'collectives and rural collective economic organizations are not the same organizational body,as can be seen from the value orientation of the creation of the two systems,the systematic interpretation of the relevant legal provisions and the scope of membership,which are different organizational bodies.The resource assets and public assets of the farmers'collectives are managed by the villagers'committees,which are self-governing organizations of the farmers'collectives,and the rural collective economic organizations operate and manage the operational assets of the farmers'collectives on their behalf.
