烟花爆竹治安管理的制约因素及解决对策

Restrictive Factors and Countermeasures Against Fireworks Management

烟花爆竹安全管理责任和体制的变革、相关法律法规的滞后及条文的冲突、行政管理与风俗习惯的不协调等给公安机关烟花爆竹治安管理带来了一些难题。其中,最典型的表现是烟花爆竹管理法律制度的滞后对公安机关执法工作的制约。推动相关立法的完善,加强法律法规衔接的研究,通过规范性文件弥补监管漏洞,加强烟花爆竹技术规范的研究,推进社区警务网格化与烟花爆竹燃放管理的深度融合,是可行的破局思路。

The reform of the management responsibility of fireworks,the lag of relevant laws and regulations and the conflict between provisions,the inconsistency between administration and customs have brought some difficulties to the public security organs’management over fireworks.Among them,the most striking is the restriction from the lag of regulations on the law-enforcement of public security organs.It is a feasible way to promote the improvement of relevant legislation,strengthen the connection among different laws and regulations,make up for regulatory loopholes through normative documents,strengthen the research on the technical specifications of fireworks,and promote the deep integration of community policing with fireworks management.
