海南种业知识产权保护法治化:现状、问题检视与前瞻

Legalization of Intellectual Property Protection in Hainan Seed Industry:Current Situation,Problems and Prospects

知识产权的竞争是未来种业竞争的核心,关乎着中国种业的创新发展。本研究首先从政策法律法规、司法实践等角度探究海南种业知识产权保护法治化建设的现状并剖析其存在的问题,主要为知识产权保护法律体系不全、知识产权保护期力度不够、种业行业融合发展水平不高、实质性派生品种(EDV)制度适用率不大、知识产权保护专业人才队伍不强等。其次提出海南种业知识产权保护法治化建设的优化路径,如制定专门的植物新品种知识产权保护法规;加强运用多种治理手段,完善种业知识产权体系;扩大种业知识产权保护与国际知识产权规则接轨;加大对种业知识产权保护的力度,提升种业知识产权保护的意识等。最后展望海南种业知识产权保护法治化的未来发展方向。

The competition of intellectual property rights is the core of future seed industry competition,which is related to the innovative development of China's seed industry.This study first explores the current situation of the legalization of intellectual property protection inHainan seed industry from the perspectives of policies,laws,regulations,and judicial practiceand analyze its existing problems,mainly including incomplete legal system for intellectual property protection,insufficient protection period for intellectual property,low level of integration and development in the seed industry,low applicability of sexual derivative varieties(EDV) system,and weak professional talent team for intellectual property protection.Secondly,it proposes the optimization path for the legalization of intellectual property protection in Hainan's seed industry,such as develop specialized regulations for the protection of intellectual property rights of new plant varieties;Strengthen the use of various governance measures to improve the intellectual property system of the seed industry;Expanding the integration of intellectual property protection in the seed industry with international intellectual property rules;Strengthen the protection of intellectual property rights in the seed industry,enhance awareness of intellectual property protection in the seed industry,etcFinally,we look forward to the fu ture development direction of the legalization of intellectual property protection in Hainan seed industry.
